Protection of personal information

On September 22nd, 2022, Law 25 about the protection of personal information will gradually start to be enforced within a period of three years. This law encompasses the rules of practices for health professionals, including psychotherapists and marriage and family therapists.

As a psychotherapist, marriage and family therapist, and sole proprietor in private practice, I will from now on have the following responsibilities within my practice:

  • Apply the law on the protection of personal information

  • Reply to requests related to personal information (for example: access, correction…)

  • Set up rules of governance related to personal information

  • Hold a registry of communication of personal information

  • Inform The Commission for Access to Information (CAI) of any incident related to confidentiality involving personal information

  • Hold a registry of confidentiality incidents involving personal information

Additional measures will be set up by 2024; further information will follow.

Protection des renseignements personnels

Le 22 septembre 2022, la loi 25 concernant la protection des renseignements personnels commencera graduellement à entrer en vigueur, et ce, sur une période de 3 ans. Cette loi touche notamment les normes de pratiques des professionnels de la santé, dont font partie les psychothérapeutes et les thérapeutes conjugaux et familiaux.

Comme psychothérapeute, thérapeute conjugal et familial et travailleuse autonome, j'aurai désormais les responsabilités suivantes au sein de ma pratique:

  • Appliquer la Loi sur la protection des renseignements personnels

  • Répondre aux demandes relatives aux renseignements personnels (ex. accès, rectification, cession de diffusion, etc.)

  • Mettre en place des règles de gouvernance relatives aux renseignements personnels

  • Tenir des registres de communication des renseignements personnels

  • Aviser la Commission d’accès à l’information de tout incident de confidentialité impliquant des renseignements personnels

  • Tenir un registre des incidents de confidentialité impliquant des renseignements personnels

D'autres mesures seront aussi à mettre en place d'ici 2024; de plus amples informations suivront.
